How long do I have to file an accident claim in Malaysia?

Under the Limitation Act 1953, a personal injury claim must generally be filed within 3 years of the date of the accident. For fatal accident claims, the limitation period runs from the date of death. Do not wait — contact us as early as possible to preserve your rights.

Can I still claim if I was partly at fault?

Yes. Malaysian law allows for contributory negligence — your compensation may be reduced proportionally if you share some fault, but you are not barred from claiming entirely. We will assess the facts and advise you on your realistic entitlement.

What if the other driver was uninsured or cannot be identified?

If the other party is uninsured or the vehicle is untraced, you may still have a claim under the Motor Insurers' Bureau of Malaysia (MIB) agreement. We can advise on the conditions and assist with the MIB claim process.

Do I need to go to court for an accident claim?

Not necessarily. Many accident claims settle through negotiation with the insurer before reaching court. However, if the insurer's offer is inadequate or liability is disputed, we may need to file suit. We will advise you on the realistic prospects and the expected process at each stage.
